SUBJECT: 400s: Academic affairs EFFECTIVE: January 22, 2009
Section: 403.7.0 Transfer Appeals

The purpose of this policy is to develop a consistent means by which a student or an NDUS institution may appeal academic transfer decisions made by receiving NDUS institutions. An appeal under this policy must refer to one of the statewide transfer policies. Those policies include 1) the General Education Requirements Transfer Agreements (GERTA), 2) Common Course Numbering (CCN), 3) statewide articulation agreements, and/or 4) national credit-by-exam programs, including the College Level Examination Program (CLEP), Advanced Placement (AP), International Baccalaureate (IB) or the DANTES or DSST program.

  1. Each institution must have a student appeal process for transfer decisions. The appeal process must allow students the opportunity to question transfer decisions concerning their academic record and must allow for an impartial review by qualified faculty or staff. The institution must provide a written response, with a rationale for the final decision, to the petitioner; and inform each petitioner that there is a system-level appeal process. Institutions may not discriminate against, sanction or retaliate in any way against a student because the student files an appeal.

  2. To take advantage of the system-level appeal process, students must:
    1. Exhaust all appeals processes on the receiving campus
    2. Provide system-level staff with all documentation related to the appeal, including copies of institutional appeals and decisions.
    3. Provide system-level staff with copies of all academic transcripts.
    4. Provide system-level staff with copies of syllabi if necessary.
    5. Sign the system-level appeal form.
  3. Upon receipt of a system-level appeal, NDUS articulation and transfer staff shall review the appeal and contact any and all necessary staff and faculty at both the sending and receiving institution to resolve the issue. After the investigation, the NDUS articulation staff shall make a formal recommendation to the NDUS Vice Chancellor for Academic and Student Affairs, the receiving vice president/dean of academic affairs, and the sending vice president/dean of academic affairs.

  4. Upon receipt of a recommendation, the NDUS Vice Chancellor for Academic and Student Affairs shall recommend a solution to the Chancellor who will render final judgment on the merits of the appeal if necessary and will advise the petitioner, the receiving campus, and the sending campus of the decision.
